The Formula ("we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information when you use The Formula mobile application and related services (the "Service"). This Policy applies to professionals who create accounts and use the Service in connection with their work.

2. Information We Collect

We collect information in the following categories:

Account Information: name, email address, authentication provider, profile details, and account preferences.

Client Information: client names, contact details, notes, and other information you choose to store in client profiles.

Photos and Media: images and related metadata you upload, including before-and-after photos and optional notes or tags.

Formula and Formulation Data: brand and product line selections, hair state inputs, shade selections, generated formulas, feasibility results, saved formula names, and related technical details.

Usage and Device Information: app interactions, feature usage, log data, device type, operating system, app version, IP address, and diagnostic or crash information.

Communications: messages you send to support and records of your requests.

3. How We Use Information

We use information to:

• provide, maintain, and secure the Service;
• authenticate users and manage accounts;
• generate, store, and display formulas and client records you create;
• process photo uploads and related features;
• respond to support requests and communicate about the Service;
• monitor performance, troubleshoot, and prevent fraud or abuse;
• analyze usage to improve features and reliability;
• comply with legal obligations and enforce our Terms of Service.

4. Aggregated Formula Usage Data Shared with Partners

We may share aggregated, anonymized, or de-identified formula usage data with hair color manufacturers, brand partners, and other companies. This may include information such as product and shade selections, hair state inputs (for example, starting level, tone, and gray coverage ranges), formulation outcomes, feasibility results, and general usage patterns.

We do not share personal information as part of these partner reports. Specifically, we do not share your name, email address, account credentials, client names, client contact information, client photos, client notes, or other data that identifies you or your clients with these partners.

We take reasonable steps to ensure shared data is aggregated or de-identified so that it cannot reasonably be used to identify you or any individual client.

5. Other Disclosures of Information

We may disclose information in these additional circumstances:

Service Providers: We use vendors for hosting, storage, authentication, analytics, customer support, and other operational functions. They may access information only to perform services for us and are contractually required to protect it.

Legal and Safety: We may disclose information if required by law, legal process, or government request, or when we believe disclosure is necessary to protect rights, safety, security, or the integrity of the Service.

Business Transfers: If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction, subject to standard confidentiality protections.

With Your Direction: We may share information when you ask us to do so or otherwise give consent.

We do not sell your personal information.

6. Data Retention

We retain information for as long as your account is active and as needed to provide the Service. We may retain certain information longer when necessary for security, fraud prevention, dispute resolution, legal compliance, or enforcement of our agreements. When information is no longer needed, we take reasonable steps to delete or de-identify it, subject to technical and legal limitations.

7. Security

We implement reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, or alteration. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Your Rights and Choices

Depending on where you live, you may have rights to access, correct, delete, export, or restrict certain processing of your personal information, and to object to or withdraw consent for certain uses. You can update much of your account information in the app. To make a privacy request, contact us at privacy@theformula.app. We may need to verify your identity before responding. If you are a resident of California or another jurisdiction with specific privacy rights, you may also have the right to opt out of certain data uses and to appeal our response to a request where required by law.

9. Client Information and Your Responsibilities

You control the client information and photos you enter into the Service. You are responsible for providing any notices and obtaining any consents required by law before collecting, storing, or uploading client information or images. The Formula processes client information on your behalf as part of providing the Service and does not use client personal information for partner analytics as described in Section 4.

10. Children's Privacy

The Service is not directed to individuals under 18, and we do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us at privacy@theformula.app and we will take appropriate steps to delete it.

11. International Users

If you access the Service from outside the United States, your information may be processed and stored in the United States or other countries where we or our service providers operate. These locations may have different data protection laws than your home country. By using the Service, you understand that information may be transferred internationally as needed to provide the Service.

12. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice through the Service, by email, or by other reasonable means. The updated Policy will be effective when posted unless otherwise stated. Your continued use of the Service after the effective date means you accept the revised Policy.
